These Messaging Terms of Service ("Messaging Terms") govern the Everburn text message program (the "Program"), operated by ID312 LLC d/b/a Everburn ("Everburn," "we," "us"). By opting in to the Program, you agree to these Messaging Terms.

1. Program Description

The Program sends recurring text message alerts related to Everburn's right-to-buy lottery and shop updates, which may include: draw notifications, checkout link alerts, entry confirmations, preference updates, and occasional shop news. Message frequency varies based on lottery activity.

2. Consent to Receive Messages

By providing your mobile number and opting in — whether through our website form, a sign-up keyword, or checkout — you expressly consent to receive recurring automated marketing and informational text messages from Everburn at the number provided. Consent is not a condition of any purchase.

Message and data rates may apply. Frequency varies. You are responsible for any charges from your mobile carrier.

3. Opting Out

You can cancel at any time by replying STOP to any text message you receive from us. After you send STOP, we will send one final message confirming your unsubscription. Replying STOP to a text alert does not remove you from the lottery pool or our email list — it only stops text messages. To pause or exit the lottery itself, follow the instructions in our lottery communications.

5. Eligibility

You must be 18 years of age or older and the account holder (or have the account holder's permission) for the mobile number provided. The Program is intended for U.S. residents.

6. Number Changes

You agree to notify us promptly if you change or deactivate your mobile number, by replying STOP from the old number (if possible) or contacting us through our website. You are responsible for messages sent to a number you no longer control until we are notified.

7. Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed. We are not responsible for delays or failures in delivery, including missed checkout link notifications resulting from carrier issues, device settings, or an unreachable number.

8. Privacy

Information collected through the Program is handled in accordance with our Privacy Policy: https://everburn.store/policies/privacy-policy. We do not sell your mobile number. Mobile opt-in data and consent will not be shared with third parties for their marketing purposes.

9. Changes to These Terms
